01

Can foreigners buy property in Azerbaijan?

Yes. Foreign individuals and foreign companies can buy and own buildings in Azerbaijan: apartments, private houses, offices, retail premises, hotels and industrial facilities. You do not need to live in Azerbaijan to buy.

Ownership becomes legally valid only once it is entered in the state real estate register. Registration is the step that completes a purchase — not the payment or the signature alone.

02

The one major restriction: land

Under the Land Code of the Republic of Azerbaijan, foreign citizens, stateless persons and foreign legal entities cannot own land. They can use land under a lease agreement.

When buying a private house or a villa, the right to the plot beneath the building has to be checked separately before the purchase.

03

Residence permits linked to property

Owning real estate can support a residence application under the Migration Code of the Republic of Azerbaijan. Ownership does not grant residence automatically — you apply separately to the State Migration Service.

  • Temporary residence permit: real estate in Azerbaijan worth at least AZN 100,000 (Article 45.1.3). The permit is issued for up to one year and can be extended for up to two years at a time.
  • Permanent residence permit: real estate worth at least AZN 200,000 (Article 52.1.3), after at least two years of temporary residence. It is issued for five years and can be renewed.
  • The application is supported by an extract from the state real estate register and a valuation report issued by a licensed valuer.

A bank term deposit of the same amount is an alternative ground under the same articles.

04

How a purchase works

  1. Choose the property and request its documents, including the extract from the state real estate register.
  2. Carry out legal due diligence: confirm the seller's title and check for mortgages, arrests, other encumbrances and any debts tied to the property.
  3. Agree the price, the payment schedule and the terms; a preliminary agreement with a deposit is common.
  4. Sign the sale agreement before a notary.
  5. Register the ownership in the state real estate register. Ownership passes on registration.

A foreign buyer needs a valid passport. Documents may require a notarised Azerbaijani translation, and a purchase can be completed through a representative under a power of attorney.

05

Costs and taxes to plan for

Budget for more than the purchase price. Typical transaction costs include notary fees, the state registration fee, a property valuation, and translation or legalisation of documents. After the purchase, owners pay annual property tax, tax on rental income if the property is let, and tax may apply to the gain when it is sold. Rates depend on the property and on the owner's tax status, so ask for a written estimate before you commit.

Prices in Baku are often quoted in US dollars, while contracts and state fees are in manats (AZN). The manat has been held at about 1.70 per US dollar since 2017.
